OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA 5 Year No. 70 ADDIS ABABA - 10h September , 1999 CONTENTS Council of Ministers Regulations No. 56/1999 Pre - Shipment Inspecton Service Fees Council of Ministers Regulations Page 1154 COUNCIL OF MINISTERS REGULATIONS NO . 56/1999 COUNCIL OF MINISTERS REGULATIONS TO DETERMINE THE FEES PAYABLE ON PRE - SHIPMENT INSPECTION SERVICES These Regulations are issued by the Council of Ministers pursuant to Article 5 of the definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Pre - Shipment Inspection Scheme Establishment Proclamation No.173 / 1999 . Short Title These Regulations may be cited as the “ Pre - shipment Inspection Service Fees Council of Ministers Regulations No. 56/1999 . ” 2. Definitions Unless the context requires otherwise , the terms and clauses used in these Regulations shall have their respective meanings attributed to them in the Pre - Ship ment Inspection Scheme Establishment Proclamation No. 173/1999 . 3. Obligations of the Importer The importer shall pay Pre - shipment Inspection service fee for all imports for which Clean Report of Findings ( CRF ) and / or Non - Negotiable Report of Findings ( NNRF ) have been issued based on the outcome of the inspection . Price The African Law Archive 2 ) effect advance payment in accordance with Article 4 of these Regulations and submit the receipt to the bank opening the Letter of Credit and / or to the bank processing importation in another mode of payment . 4. Rate of Payment The importer of goods on which pre - shipment inspection has been effected shall pay to the Ethiopian Customs Authority : 1 ) 1 % ( One per cent ) of the total EIF value of the goods ; 2 ) the birr equivalent of US 190 dollars ( One hundred ninety United States dollars ) whenever the ad valorem rate specified under Sub - Article ( 1 ) of this Article produces a service charge less than USD 190 ( One hundred ninety United States dollars ) . 5. Mode of Payment 1 ) The importer shall effect an advance payment to the Ethiopian Customs Authority computed on the amount of the proforma invoice before the opening of the Letter of Credit or the issuance of the Purchase Order . 2 ) Upon receipt of the Report of Findings the service fee shall be assessed on the duty paying value of the goods , and on the basis of the outcome of the assessment the importer shall pay the additional service fee or receive refunds . 3 ) The service fee shall be adjusted before the goods are cleared from the Custom's area . 6. Obligations of the Company The company providing pre - shipment inspection service shall : 1 ) collect the advance payment receipt from the bank opening the Letter of Credit and / or from the bank processing importation in another mode of payment . 2 ) not render pre - shipment inspection services to an importer who did not make advance payment . 7.
