Year No. 1 ADDIS ABABA - 124 October , 1998 ] CONTENTS Council of Ministers Regulations No. 41/1998 Leather Leather Products Technology Institute Establishment Council of Ministers Regulations Page 848 COUNCIL OF MINISTERS REGULATIONS NO . 41/1998 COUNCIL OF MINISTERS REGULATIONS TO PROVIDE FOR THE ESTABLISHMENT OF LEATHER AND LEATHER PRODUCTS TECHNOLOGY INSTITUTE These Regulations are issued by the Council of Minis ters pursuant to Article 5 of the Definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 4/1995 . 1. Short Title These Regulations may be cited as the “ Leather and Leather Products Technology Institute Establishment Council of Ministers Regulations No.41 / 998 . ” 2. Definitions In these Regulations , “ Ministry ” or “ Minister ” means the Ministry or the Minister of Trade and Industry , respectively . 3. Establishment 1 ) There is hereby established the Leather and Leather Products Technology Institute ( hereinafter “ the Institute ' ' ) as an autonomous federal government institution having its own legal personality . Head Office The Institute shall have its head office in Addis Ababa and may have branch offices in other places , as may be necessary . 5. Objectives The objectives of the Institute shall be to produce trained manpower for the sector by providing theoretical and practical trainings , and conducting research and consul tancy activities in all aspects of leather and leather products manufacture , raw materials , chemical proces ses , mechanical operations and quality control methods . 6. Powers and Duties Without prejudice to specific powers and duties given by law to other government institutions , the Institute shall have the following powers and duties : 1 ) to increase the number of professionals of the sector by providing trainings at various levels in leather and leather products technology ; 2 ) to undertake applied research and development activities which can improve the quality and quantity of leather and leather products ; 3 ) to upgrade the quality standards of leather and leather products by providing consultancy services ; 4 ) to provide information services which facilitate the growth of the sector ; 5 ) to confer academic certificates and diplomas to trainees ; 6 ) to charge fees for services it renders ; 7 ) to own property , enter into contract , sue and be sued in its own name ; 8 ) to engage in other activities necessary to accomplish its objectives . 7. Organization of the Institute The Institute shall have : 1 ) a Board of Management ( hereinafter the “ ' Board ” ' ) ; a Director to be appointed by the government upon the recommendation of the Minister ; an Academic council ; and 4 ) the necessary staff . 8. Members of the Board 1 ) The Board shall constitute seven members to be designated by the Government from private sector and government itions . 2 ) The Chairperson shall be assigned by the Govern ment from among the members of the Board . Powers and Duties of the Board The Board shall have the following powers and duties : 1 ) to supervise and follow - up the activities of the Institute and ensure that it functions in accordance with its objectives ; 2 ) to approve directives , based on the general principles of federal civil service laws , for the employment and administration of the staff of the Institute ; to deter mine salary scales and other incentives and follow up the implementation of same ; 3 ) to approve the employment , assignment and dismis sal of officials directly accountable to the Director ; 4 ) to determine fees to be charged by the Institute for the services it renders ; 5 ) to endorse agreements to be concluded by the Institute with local or foreign institutions ; 6 ) to submit the work program and budget of the Institute to the Ministry and , upon approval , supervise the implementation of same ; 7 ) to approve the internal regulations of the Institute to be prepared pursuant to these Regulations , and follow - up the implementation of same ; 8 ) to deliberate and decide on other policy issues proposed by the Director ; 9 ) to give general directives to the Director ; 10 ) to evaluate the performance report of the Institute , quarterly , and submit same to the Ministry together with its comments . 10. Meetings of the Board 1 ) The Board shall have a regular meeting every month ; it may , however , convene extraordinary meetings as deemed necessary . 2 ) There shall be a quorum where more than half of the members of the Board are present . 3 ) without prejudice to the provisions of sub - Article ( 2 ) of this Article , the Board shall decide by a majority vote . In case of a tie the Chairperson shall have a casting vote . 4 ) Subject to the provisions of this Article , the Board may issue its own rules of procedure . 11. Powers and Duties of the Director 1 ) The director shall be the chief executive officer of the Institute and , as such shall , subject to the general directives of the Board , direct and administer the activities of the Institute . 2 ) Without limiting the generality of sub - Article ( 1 ) of this Article , the Director shall : ( a ) exercise the powers and duties of the Institute specified in Article 6 of these Regulations ; ( b ) study and submit to the Board the adminis trative manual , salary scale and other incentives of the Institute and implement same upon approval ; The African Law Archive No. 1 12 October , 1998 - Page 851 ( c ) prepare and ubmit to the Board the work program and budget of the Institute and im plement same.upon approval : ( d ) effect payment in accordance with the approved budget and work program of the Institute ; ( e ) represent the Institute in its dealings with third parties ; ( f ) : submit to the Board the performance and finan cial reports of the Institute . 3 ) The Director may delegate part of his powers and duties to officers and other employees of the Institute to the extent necessary for the effective performance of the activities of the Institute . 12. Members of Academic council The Academic Council of the Institute shall consist of the following members : 1 ) the director of the Institute Chairman 2 ) the registrar of the Institute member 3 ) the Student's representative 4 ) the Teacher's representative 5 ) representatives from the various Departments of the Institute to be designated by the Board 13. Powers and Duties of the Academic Council The Academic Council shall have the following powers and duties : 1 ) to examine and submit to the board the academic program and calendar of the Institute ; 2 ) to undertake study the conferring of dip certificates and special awards and submit it to the board ; 3 ) to prepare and submit to the board , criteria for admission of students and trainees , determination of academic standards , evaluation , disciplinary and graduation matters , and implement same upon ap proval ; examine and decide on grievances and complaints on these matters ; 4 ) to determine methods and conditions of ex amination ; udy and summit to the Board promotions in academic rank ; 6 ) to examine and decide on the list of students to be promoted to the next academic level ; 7 ) to determine its own rules of procedure ; 8 ) to perform such other duties as may be given to it by the Board . 14. Budget , The budget of the Institute shall be drawn from the following sources : 1 ) financial subsidy allocated by the Federal Govern ment ; 2 ) fees collected from its services ; and 3 ) grants , donations and any other sources of income . 15 ) Books of Account 1 ) The Institute shall keep complete and accurate books of accounts . The African Law Archive 2 ) The books of accounts and financial documents of the Institute shall be annually audited by the Auditor General or by an external auditor assigned by him . 16. Effective Date These Regulations shall come into force on the date of Done at Addis Ababa , this 12th day of October , 1998 .
