Page 3145 PROCLAMATION NO . 457/2005 A PROCLAMATION TO PROVIDE FOR RAW HIDE AND SKIN MARKETING SYSTEM WHEREAS , it has been found necessary , that the should be based upon quality , and that the collection , processing , warehousing and transportation process of the product should be improved with a view to obtaining the benefit that could accrue from the sub sector ; NOW , THEREFORE , in accordance with Article የሚከተለው 55 ( 1 ) of the Constitution of the Federal Democr.it Republic of Ethiopia , it is hereby proclaimed as follows : 1. Short Title This Proclamation may be cited as the “ Raw Hide Marketing System Proclamation No.457 / 2005 . ” 2. Definition In this Proclamation , unless the context requires otherwise : “ marketing System ” means the collection , processing , transporting and selling process of raw hide and skin ; Unit Price * The African Law Archive 15 July , 2005 ... Page 2 / “ raw hide ” means any fresh , air - dried or salted hide obtained from bull , ox , cow , heifer or camel and includes any other hide designated as such by the Ministry ; 3 / “ raw skin means any fresh , air - dried or salted skin obtained from sheep , goat , crocodile , calf or fish and includes any other skin designated as such by the Ministry ; “ fresh hide or skin ” means unsalted or not air dried hide or skin ; 5 / “ certificate of competence ” means a certificate issued to certify eligibility for collecting , preserving , storing and transporting raw hide and skin ; 6 / “ marketing participants ” means_collectors , suppliers , abattoirs and factories that are engaged in the trading of raw hides and skins ; 7 / “ means of transportation ” mans a vehicle which provides service to transport raw hides and skins and includes pack animals ; 8 / “ Ministry ” means , the Ministry of Agricul- ture and Rural Development ; 9 / “ competent authority ” means the Ministry , as regards to the export marketing system , and a regional body in charge of following up agricultural and rural development activities , as regard to the domestic marketing system ; 10 / “ person ” means a natural or a juridical person . 3. Scope of Application This Proclamation shall be applicable to all raw hide and skin marketing participants . 4. Certificate of Competence 1 / Prior to obtaining raw hide and skin trading license , it is compulsory to get certificate of competence from the competent authority ; * The African Law Archive 15 July , 2005 ... Page The criteria and pre - conditions required for issuance and renewal of certificate of competence shall be determined by the directives to be issued by the Ministry . 5. Processing and Transportation of Raw Hides and Skins A person who processes raw hides and skins shall have appropriate facilities built as per the directives issued by the Ministry ; 2 / Raw hides and skins could be transported from the processing facility to any other place in accordance with the directives issued by the Ministry . The consignment shall be sealed in plump by an inspector . assigned by the competent authority and that it shall be accompanied by a certificate signed by the inspector ; A person who transports raw hide and skin shall keep with him the certificate of consignment and shall present it when requested by any inspector assigned by the competent authority . 6. Raw Hide and Skin Marketing Raw hide and skin marketing shall be carried out at any level , on the basis of the quality standards issued by the Ethiopian Quality and Standards Authority , and on the basis of : 1 / width where it is raw skins ; 2 / weight where it is raw hide . 7. Prohibition 11. No person shall engage in raw : hide and skin trade without obtaining a trade license ; 2 / No person shall transport and sell raw hide and skin to areas not authorized . 8. Marketing Information Any raw hide and skin marketing participant shall : 1 / ' keep record of own daily purchased quantity and price of raw hide and skin ; * The African Law Archive 15 July , 2005 ... Page 2 / record and keep of own daily sales quantity and buyers of raw hide and skin ; maintain quality information of the daily purchased raw hide and skin ; and shall furnish same when requested by the competent authority . 9. Inspection and Administrative Measures An inspector assigned by the competent authority shall , upon showing his identification card , make inspection to ensure the proper implementation of the provisions of this Proclamation and regulations and directives issued hereunder . 2 / The trade license of a raw hide and skin marketing participant may be suspended cancelled where he fails to comply with the provisions of this Proclamation and regulations and directives issued hereunder . 3 / Without prejudice to administrative measure that may be taken by the appropriate Authority , if raw hides and skins found stored or transported by a person having no license may be considered as contraband goods and appropriate punishment measure will be taken . wArc . A person who provides information leading to the seizure of hides and skins stored ' or transported by unlicensed trader may be , paid a commission by the competent authority . 10. Power to Issue egulations and Directives 11 The Council of Ministers and the Ministry may issue regulations and directives , respectively , necessary for the proper implementation of this Proclamation with respect to hides and skin export marketing system . Regional states may issue regulations and directives necessary proper implementation of this Proclamation with respect to hide and skin domestic marketing system . * The African Law Archive 15 July , 2005 ... Page 11. Repealed Laws The Raw Hide and Skins Regulation No. 25/1975 is hereby repealed . 21. No law , regulation , directive or practiqe shall , in it is inconsistent with this Proclamation , be applicable with respect to matters provided for by this Proclamation . 12. Effective Date This Proclamation shall enter into force on this 15th date of July , 2005 Done at Addis Ababa , this 15th day of July , 2005 .
