WHEREAS, a Special Penal Code suited to the change in progress in our country has been promulgated; and
WHEREAS, in as much as the said Code is intended to be
Code of 1961 which is operative in the ordinary courts of law needs to be tailored to fit the requirements of the Special Courts martial ;

NOW, THEREFORE, in accordance with Article 6 of the Definition of Powers of the Provisional Military Administration
This Proclamation may be cited as the " Special Criminal Procedure Code Proclamation, No. 9 of 1974. "

In this Proclamation
(1) " Criminal Procedure Code " shall mean the Criminal Procedure Code of 1961 (Proclamation No. 185 /
(2) " Special Courts - martial " shall mean the Courts estab lished under the Special Courts - martial Establishment Proclamation, No. 7 of 1974.
3. Application of the Criminal Procedure Code:
(1) The Criminal Procedure Code shall be applicable to all matters falling under the jurisdiction of the Special Courts - martial except Articles 42 (1) (c), 42 (3), 63 to 79 (inclusive), 80 to 93 (inclusive) 106, 181 to 196 (inclusive) and 161 (2) thereof.
