OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA 8th Year No. 3 ADDIS ABABA - 124 October , 2001 CONTENTS Proclamation No. 257/2001 Ethiopian National Security Council Establishment Proclamation Page 1636 PROCLAMATION No. 257/2001 A PROCLAMATION TO PROVIDE FOR THE ETHIOPIAN NATIONAL SECURITY COUNCIL WHEREAS , it is necessary to introduce a mechanism that security ; NOW , THEREFORE , in accordance with Article 55 ( 1 ) of Ethiopia , it is hereby proclaimed as follows : 1. Short Title This Proclamation may be cited as the “ Ethiopian National Security Council Establishment Proclamation No. 257/2001 . ” 2. Establishment 1 ) The Ethiopian National Security Council ( hereinaf ter the " Council ' ' ) is hereby established . 2 ) The Council may have different committees as may be necessary . 1 ) The Council shall have the following ex - officio members : ( a ) the Prime Minister Chairperson ( b ) the Deputy Prime Minister ... Deputy Chairper ( c ) the Foreign Affairs Minister ( d ) the Defence Minister . ( e ) the Head of the Security , Immigration and Refugee Affairs Authority ( f ) the Chief of Staff of the Armed Forces ( g ) the Head of the Office of the Prime Minister Member and Secretary . Member The African Law Archive 2 ) Notwithstanding the provisions of Sub - Article ( 1 ) of this Article , the Prime Minister may : ( a ) designate additional members of the Council ; ( 6 ) allow any person to attend meetings of the Council with a status of an expert adviser . 4. Functions of the Council 1 ) The Council shall have the function of advising the Prime Minister with respect to the integration and the following up of the proper implementation of domestic , foreign and defence policies relating to the national security . 2 ) Without limiting the generality of Sub - Article ( 1 ) of this Article , the Council shall : assess national security threats and forward recommendations on measures to be taken ; ( b ) propose implementation guidelines relating to national security measures ; ( c ) deliberate on any issue affecting the national security . 3 ) The Council shall also carry out functions that may be determined by Regulations of the Council of Ministers in the case where a state of emergency has been declared in accordance with Article 93 of the Constitution of the Federal Democratic Republic of Ethiopia . 5. Meetings of the Council 1 ) The Council may have meetings at any time when ever convened by the Prime Minister . 2 ) The presence of more than half of the members shall constitute quorum for any meeting of the Council . 3 ) The Council may adopt its own rules of procedures . 6. Committees of the Council The membership and functions of committees to be established under Sub - Article ( 2 ) of Article 2 of this Proclamation shall be determined by the Council . 7. Effective Date This Proclamation shall enter into force as of the 12th day of October , 2001 . Done at Addis Ababa , this 12h day of October , 2001 .
