Page 1150 COUNCIL OF MINISTERS REGULATIONS NO . 54/1999 COUNCIL OF MINISTERS REGULATIONS TO PROVIDE FOR THE ESTABLISHMENT OF THE ETHIOPIAN DEVELOPMENT RESEARCH INSTITUTE These Regulations are issued by the Council of Minis ters pursuant to Article 5 of the Definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 4/1995 .. These Regulations may be cited as the “ Ethiopian Development Research Institute Establishment Council of Ministers Regulations No. 54/1999 . ” 2. Establishment 1 / The Ethiopian Development Research Institute ( hereinafter the Institute ' ' ) is hereby established as an autonomous institution having its own legal personality . 2 / The Institute shall be accountable to the Prime Minister . 3. Head Office The Institute shall have its head office in Addis Ababa and may have branch offices elsewhere as may be necessary . 4. Objectives The objectives of the Institute shall be to undertake studies and research on the development of the country . The African Law Archive – No. 68 27 August , 1999- Page 1 151 Powers and Duties The Institute shall have the powers and duties to : 1 ) undertake studies and research with a view to assisting the formulation of development policies ; 2 ) carry out impact analysis of development policies implemented by the Government ; 3 ) collect data it requires in the course of its studies and research and to use those compiled by other bodies ; 4 ) publish and distribute results of its research ; 5 ) render consultancy services in development areas ; 6 ) establish relations with domestic and foreign ins titutions that may contribute towards achievements of its objectives ; 7 ) own property , enter into contracts , sue and be sued in its own name ; 8 ) perform such other activities as may be necessary for the attainment of its objectives . 6. Organs of the Institute The Institute shall have : 1 ) a director to be appointed by the Government ; and the necessary staff . 7. Powers and Duties of the Director 1 ) The Director shall be the chief executive officer of the Institute and shall direct and administer the activities of the Institute . 2 ) Without limiting the generality of the provisions of Sub - Article ( 1 ) of this Article , the Director shall : ( a ) exercise the powers and duties of the Institute stated under Article 5 of these Regulations ; ( b ) employ and administer employees of the Ins titute following the basic principles of the Federal Civil Service laws ; ( c ) prepare and submit to the office of the Prime Minister the work program and budget of the Institute ; and implement same upon approval ; ( d ) effect expenditure in accordance with the ap proved budget and work program of the Ins titute ; ( e ) represent the Institute in all its dealings with third parties ; ( f ) prepare and submit to the Office of the Prime Minister the activity and financial reports of the Institute ; 3 ) The Director may , to the extent necessary for the efficient performance of the activities of the Institute , delegate part of his powers and duties to the em ployees of the Institute ; provided , however , that prior approval of the Office of the Prime Minister shall be required in the case of a person working on behalf of the Director for more than 30 days . 1 ) The budget of the Institute shall be drawn from the following sources : The African Law Archive No. 68 27 August , 1999Page 1152 ( a ) budgetary appropriations made by the Govern ment ; ( b ) consultancy service fees and proceeds from the sale of publications ; ( c ) donations and assistance . 2 ) The funds referred to in Sub - Articles 1 ( b ) and ( c ) of this Article shall be deposited in a bank account opened in the name of the Institute nd shall be expended for the carrying out of the activities of the Institute . 9. Books of Accounts 1 ) The Institute shall keep complete and accurate books of accounts . 2 ) The accounts and financial documents of the Ins titute shall be audited annually by the Auditor General or by an auditor appointed by him . 10. Effective Date These Regulations shall enter into force as of the date of Done at Addis Ababa , this 27 th day of August , 1999 .
