A PROCLAMATION TO AMEND THE PUBLIC SERVANTS ' PENSION PROCLAMATION WHEREAS , it has become necessary to amend the Public Servants ' Pension Proclamation No. 345/2003 ; on this com NOW , THEREFORE , in accordance with Article 55 ( 1 ) of the constitution of the Federal Democratic Republic of Ethiopia , it is hereby proclaimed as follows : 1. Short Title This Proclamation may be cited as the “ Public Servants ' Pension ( Amendment ) Proclamation No. 2. Amendment The Public Servants ' Pension Proclamation No. 345/2003 is hereby amended as follows : ( 1 ) A new Sub Article ( 3 ) is added to Article 13 and Sub - Articles ( 3 ) and ( 4 ) are renumbered as Sub Articles ( 4 ) and ( 5 ) respectively : Unit Price The African Law Archive " ( 3 ) A public servant who has completed at least 20 years of service and who has attained at least 45 years of age may receive retirement pension for life where the government office he has been working for has ceased to exist or he is reduced from the work force in connection with -privatization or his contract of employment is terminated as a result of inefficiency by the decision of the Council of Ministers . " 2 / Sub - Article ( 2 ) of Article 17 is deleted and replaced by the following new Sub - Article ( 2 ) : " ( 2 ) If a beneficiary who has been receiving invalidity pension re - enters the public service and receives salary , the pension shall be discontinued . ” 31 Sub - Article ( 2 ) of Article 30 is deleted and replaced by the following new Sub - Article ( 2 ) : " ( 2 ) If a beneficiary who is receiving incapacity pension re - enters the public service and receives salary ; the pension shall be discontinued . " 3. Effective Date This Proclamation shall come enter into force as of the 28th day of October 2004 . Done at Addis Ababa , this 28th day of October , 2004 .
