A PROCLAMATION TO PROVIDE FOR THE GRANTING OF EXCLUSIVE AGENCY ON CERTAIN EXPORT TRADE SECTORS FOR A LIMITED PERIOD OF TIME WHEREAS , the granting of exclusive agency on extensive entry into new markets ; NOW , THEREFORE , in accordance with Article 55 ( 1 ) of the Constitution , of the Federal Democratic Republic of Ethiopia , it is hereby proclaimed as follows ; 1. Short Title This Proclamation may be cited as “ the Granting of Exclusive Agency on Certain Export Trade Sectors for a limited period of time Proclamation No. 440/2005 . ” 2. Definitions In this Proclamation : 1 / “ exporter ” Means any person who has been given export license in accordance with the Commercial Registration Business Licensing Proclamation No. 67/1997 ; 2 / “ foreign company ” means a company registered in accordance with foreign laws and situated in a foreign country . 3. Objectives The Objectives of this Proclamation are : Unit Price The African Law Archive Page 3054 1 / as the gain from export trade in limited markets is so far below expectation , to make producers and the country direct beneficiaries by expending the scope of target export market ; and 21 to make conducive business situation for exporters in order to enable them to extensively enter into new markets by creating ties with renowned foreign companies and to give such companies sufficient time to recover their expenses of market development . The Granting of Exclusive Agency Following agreements between certain exporters and an importing foreign company to enter a new potential market in a foreign country , the Ministry of Trade and Industry , may issue directive to grant exclusive agency to the foreign company ; as it may be appropriate for a limited number of years ; certain export sectors , to prevent oth exporters from entering the same market otherwise than through such foreign company . 5. Prohibition No exporter may export in export trade sectors on which an exclusive agency has been granted , otherwise than through the foreign company to which the exclusive agency is granted . 6. Inapplicable Laws No law shall , in so far as it is inconsistent with this proclamation , have force or effect in respect of situations provided for by this Proclamation . Effective Date The Proclamation shall come into force as of 21st day of February , 2005 .
