Page 3109 PROCLAMATION NO.450 / 2005 . A PROCLAMATION TO PROVIDE FOR THE ESTABLISHMENT OF THE FEDERAL URBAN PLANNING INSTITUTE WHEREAS , it is found prudent to promote the centers has more than ever become a key task in the overall national development efforts ; WHEREAS , it is found important to define , ir ሥርዓት { principles , a system that would ensure a healthy and well as to facilitate the provision of capacity building supports ; WHEREAS , it is found necessary to re - establish organ of the Federal Government that is entrusted with urban planning mandates consistent with the decentralized systems put in place in the Country ; NOW , THEREFORE , in accordance with Article 55 ( 1 ) of the Constitution , of the Federal Democratic follows ; 1. Short Title This Proclamation may be cited as the “ Federa : Urban Planning Institute Establishment Proclamation No. 450/2005 . ” Unit Price The African Law Archive * 2. Definitions In this Proclamation , unless the context otherwise requires : 1 / " Minister ” or Ministry ” means the Minister or Ministry of Federal Affairs , respectively ; 2 / “ region " means any region referred to in Article 47 of the Constitution of the Federal Democratic Republic of Ethiopia and includes the administrations of Addis Ababa and Dire 3 / “ urban plan ” means the different urban plan typologies prescribed in the relevant urban planning laws . 3. Establishment 1 / The Federal Urban Planning Institute ( hereinafter “ the Institute " ) is hereby established as an autonomous public organ having its own legal personality . 21 The Institute shall be accountable to the Ministry . 4. Head Office The Institute shall have its head office in Addis Ababa and may establish branch offices elsewhere as may be necessary . 5. Objectives The Institute shall have the following objectives : to provide capacity building support to regions , urban centers and the private sector on matters pertaining to urban plan preparation and implementation ; 2 / to provide urban related consultancy services ; 3 / to serve as an information hub on urban planning and other basic urban related information ; and ; 41 to achieve a balanced urban system by way of preparing integrated urban plans that encompass socio - economic and land - use dimensions and that ensure plan - led development of urban centers that have strong linkages with their rural hinterlands and serve as centers of rapid development . * The African Law Archive * * 6. Powers and Duties The Institute shall have the following powers and duties : 1 / in the area of capacity building ፡ al to provide advise to regions and urban administrations on changes to be introduced in terms of organizational structures and working systems and procedures with a view to enhancing their urban plan preparation and implementation capacity ; to provide short and on - the - job training to staff working in region government and urban ; c / to formulate best practices by reviewing local international experience in urban planning and disseminate same . 21 in the area of research and consultancy : al to undertake follow - up and evaluation studius , in collaboration with regions and urban administrations , on the implementation of approved urban plans with a view to improving urban planning methods and working procedures and to formulate best practices in urban planning ; b / to conduct multi - disciplinary studies and researches that serve as basis for the preparation of urban plans ; to advise the Federal Government on matters that pertain to urban planning ; to provide consultancy services on matters related to urban planning to persons seeking such services ; in the area of information support services : al to serve as information hub for urban planning other basic urban related information ; bi to collect , collate and disseminate basic urban related information from the concerned governmental non - governmental institutions ; in the area of urban plan preparation : * The African Law Archive * al to prepare urban plans upon the request of regions and urban centers ; and to prepare base maps to be used in the preparation of urban plans by employing ground survey , aerial photography and other appropriate techniques . concerning services the institute renders to regions and urban centers , regions and urban center in to a cost sharing arrangement to be determined by the ministers where by they covere up to half of the total cost of service provision . 7. Organization of the Institute The Institute shall have : a General Manager and a Deputy General Manager ; and the necessary staff . Manager The Federal Government shall appoint the General Manager and the Deputy General Manager of the Institute . 9. Powers and Duties of the General Manager 1 / The General Manager shall , subject to the general directives of the Ministry , direct and administer the activities of the Institute . 21 Without limiting the generality of Sub - Article ( 1 ) of this Article , the General Manager shall : al exercise the powers and duties of the Institute specified in Article 6 of this Proclamation ; employ and administer personnel of the Institute in accordance with the federa ! civil service laws and the salary scale determined by the Government ; cl draft and submit to the Ministry policies regarding urban planning and follow up the implementation of same approval ; * The African Law Archive * prepare and submit to the Ministry the work program and budget of the Institute and implement same upon approval ; el effect expenditures in accordance with the approved budget and work program of the Institute ; represent the Institute in all its dealings with third parties ; g prepare and submit to the Ministry the annual and periodic performance and financial reports of the Institute . 3 / The General Manager may , to the extent necessary for the efficient performance of the activities of the Institute , delegate part of his powers and duties to the deputy General Manager and other officials as well as the employees of the Institute . 10. Powers and Duties of the Deputy General Manager The Deputy General Manager shall have the following powers and duties : 1 / to act on behalf of the General Manager during his absence ; to perform other duties given to him by the General Manager . Budget The budget of the Institute shall be drawn from the following sources : al budgetary allocation made by the Federal Government ; service charges to be collected by the Institute ; and cl assistance and grants to be obtained from any source . 12. Books of Accounts The Institute shall keep complete and accurate books of accounts . The books of accounts and other financial documents of the Institute shall be audited annually by the Auditor general or by auditors designated by him The African Law Archive * 13. Repeal 1 / The National Urban Planning Institute Establishment Proclamation No. 317/1987 is hereby repealed . 2 / No Proclamation , regulation , directive or practice , shall , in so far as it is inconsistent with this Proclamation , have effect with respect to matters provided for in this Proclamation . Power to Issue Regulations The Council of ministers may issue Regulations for the Implementation of this Proclamation . 15. Transfer of Rights and obligations The rights and obligations of the National urban Planning Institute established under Proclamation hereby transferred to the Institute . 16. Effective Date This Proclamation shall enter into force on the 24 day of June , 2005 .
